The 38 Auditions

These terms govern your use of this website and your entry into The 38 Auditions (the "Auditions"), run by 38 Talent Ltd ("38 Talent", "we", "us"). By entering, you accept these terms. If you don't agree with them, please don't enter.
Complete the entry form and submit your performance video (two to four minutes). You confirm that the information you give is accurate, and that the performance is yours, or that you have cleared all rights needed for us to publish it — including any rights in the underlying song if you perform a cover. Entry is free.
Submitting a video does not guarantee it will be published and does not guarantee a reward or opportunity. We review every entry and decide, entirely at our own discretion, which videos to publish to 38 Talent related social media platforms. We may choose not to publish, or later to remove, any video — for any reason and without being required to give one — and doing so creates no liability to you. Only published videos take part in the ranking.
You keep ownership of your performance. By entering, you grant 38 Talent a non-exclusive, worldwide, royalty-free licence to host, publish, stream, reproduce and share your video — on our YouTube channel, our websites and our social accounts — and to use short clips and your name, artist name and likeness to run and promote the Auditions. This licence lasts for the entirety of the auditions and a reasonable period afterwards, and you can ask us to take your video down at any time by emailing info@38talent.com.
You confirm your entry doesn't infringe anyone's rights, isn't defamatory, and doesn't contain anything unlawful. We may remove or refuse any entry at our discretion.
Accepted videos are published to 38 Talent related social media platforms and ranked by how they perform — primarily views, and also likes and comments — for a duration as per 38 Talent's discretion. Ranking uses public figures. We may also weigh a judging panel's assessment of talent and originality; where we do, the balance between public metrics and the panel is described.
Genuine engagement only. Buying, botting or otherwise faking views, likes or comments will disqualify your entry. You also may not run paid advertising to boost your video's figures — this includes Google Ads, YouTube paid promotion, or any other paid traffic directed at your entry. All views and engagement must be earned organically. We review the analytics behind entries and our decision on authenticity is final.
Reaching published milestones can unlock rewards, which may include a released single, a music video, a live performance at a 38 Talent event, a deal with 38 Talent, and more. The specific milestones, thresholds and rewards are released at 38 Talent's discretion.
Winning or performing well may lead us to discuss management, a label deal, or other representation. Any such arrangement is entirely at our discretion and only takes effect under a separate written agreement signed by both sides. Entering the Auditions, being published, or winning does not by itself create any management, label, publishing or employment relationship, and gives no guarantee of one.
Don't submit content that is hateful, harassing, sexually explicit, violent, or otherwise inappropriate, and don't impersonate anyone. We may remove entries and bar entrants who break these rules.
We may change these rules, or pause or cancel the Auditions, where reasonably necessary — for example, for legal reasons or events beyond our control. We'll post material changes on this page.
The site and the Auditions are provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or for issues caused by third-party platforms such as YouTube. Nothing in these terms limits liability that cannot be limited by law. This does not affect your statutory rights.
The Auditions are run by 38 Talent, not by YouTube or Google, and are in no way sponsored or endorsed by them. Because entries are published on YouTube, the YouTube Terms of Service also apply to those videos.
These terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless local law gives you a right to bring a claim elsewhere.
